The problem with the original P320 was what the gun industry called "inadvertent discharge," or as the Sig v. Sauer lawsuit explained, "the gun firing without pulling the trigger." On Jan. 5, 2017, Stamford Police Department SWAT team member Vincent A. Scheperis stowed tactical gear in the trunk of his hatchback and dropped his P320 pistol, he said. The gun went off on its own, and the bullet went through the back of his left knee, according to the lawsuit filed against Sig Sauer.

"The bullet could have easily taken his life," says the lawsuit filed in Connecticut federal court seven months later. "At no time during or after the incident did Officer Scheperis put his finger on the trigger of the P320 or touch the cocked weapon in any way."

Derrick Bruton and two other officers were responding to a "suspicious person" call at a suburban home when he tripped over a cinder block, setting off his P320. No one was injured. According to emails from the Riverdale Police Department, Bruton found an object carrying his gun inside the room.

"In light of this incident, I believe it may be best to immediately retire the Riverdale City Police Department's Sig Sauer P320," the city employee wrote in a letter to the police captain.
